Employment expert (arbeidsdeskundige)

An employment expert is a specialist who assesses to what extent someone can still work after injury and the consequences for their earning capacity.

Employment expert

An employment expert ('arbeidsdeskundige') is a recognised expert who investigates a person's work options after illness, condition or injury. In personal-injury cases the employment expert is central to establishing loss of earning capacity, which is recoverable under Article 6:96 BW (financial loss) and Article 6:107 BW (damage from injury).

Core tasks

Employment experts are engaged by insurers, victims (through their representative) or by the court as an independent expert. In case of conflicting reports the court may appoint a third, neutral employment expert.

Practical consequences

The employment expert's findings largely determine the level of compensation for loss of earning capacity, both for the past and the future. A well-substantiated report can make the difference between compensation of tens of thousands and several hundred thousand euros, especially for young victims with permanent limitations. It is therefore wise for the victim to respond critically to the report and, if necessary, engage their own employment expert.

After the traffic accident the court engaged an employment expert to assess whether the victim could partly resume her former work as a nurse and what loss of income was involved.
