Functionele invaliditeit
Functional disability
Functional disability is the permanent loss of bodily function expressed as a percentage, independent of the victim's occupation.
Functional disability ('functionele invaliditeit') expresses the permanent loss of function of a body part or of the whole person as a percentage. It is assessed by a medical specialist using the AMA Guides and the guidelines of the Dutch professional associations.
An important distinction:
The disability percentage is an important factor in determining damages for pain and suffering and can carry over into disability and accident insurance. By itself it says nothing about the full extent of the damage.
“The medical expert assessed a functional disability of 8% of the whole person.”
