A specialised adviser who assists victims or insurers in establishing and settling personal-injury claims, without having to be a lawyer.

Personal injury expert

A personal injury expert specialises in assessing, calculating and settling personal injury. They act as the victim's representative or, on the other side of the table, as a claims handler for an insurer. Unlike a lawyer, an expert need not have legal training, though many have a background in law, medicine or insurance. The basis for compensating reasonable costs lies in Article 6:96 BW.

Main tasks

Costs

The reasonable costs of an expert are in principle borne by the liable party (Article 6:96(2)(b) BW); in 2026 recognised experts charge hourly rates of roughly €150–€250 excluding VAT.

Practical consequences

Engaging an expert can significantly affect the outcome: a well-substantiated file increases the chance of full compensation. Victims should check whether the expert is affiliated with a recognised professional body and whether the costs are covered by the liable party or a legal-expenses insurer.

After the traffic accident the injured party engaged a personal injury expert to calculate the extent of his damage and to negotiate with the liability insurer on his behalf.
