In personal-injury practice it almost always concerns situations where a victim suffers physical or mental injury from the collision. The central provision is Article 185 of the Road Traffic Act 1994 (WVW), which establishes strict liability for the owner or keeper of a motor vehicle when it is involved in a collision with a non-motorised road user (pedestrian, cyclist).

Victims should report the accident to the police as soon as possible and seek medical help. A personal-injury claim can then be filed with the liable party's WAM insurer. Engaging a specialised personal-injury lawyer or agency is wise, as the burden of proof and damage calculation can be complex. The limitation period for personal injury is in principle five years (Art. 3:310 BW).
