Motor liability insurance (WAM)
WAM insurance is compulsory liability insurance for motor vehicles, based on the Dutch Motor Insurance Liability Act (WAM). Every owner or keeper of a motor vehicle used on the public road must insure it (Article 2 WAM). The aim is to guarantee that traffic-accident victims always have a solvent party to recover their damage from, regardless of the liable driver's financial situation.

Practical consequences
For injury victims the WAM insurance is very important: they can claim their damage — including medical costs, loss of earning capacity and pain and suffering under Article 6:106 BW — directly from the WAM insurer. The insurer must, within a reasonable period, make a reasoned offer or acknowledge or reasonedly reject liability. If the cause remains uninsured or unknown, the Guarantee Fund provides a safety net so victims are not left empty-handed.
